The Power of Words: A Decree and a Statement

On April 1, 2025, Vietnam took a significant step forward by unveiling the Draft Decree on Strategic Trade Control, becoming one of the first nations in the Asia-Pacific region to proactively establish a comprehensive legal framework in this domain. This development comes on the heels of Minister of Industry and Trade Nguyen Hong Dien’s working visit to the US, underscoring its strategic importance in terms of timing and substance.

Leading the Way

In an era where global trade faces challenges due to shifting supply chains and technological competition, Vietnam’s proactive approach to regulating strategic trade activities, particularly concerning dual-use goods, high-tech products, and sensitive items, showcases a resolute, transparent, and deeply integrated stance.

Vietnam’s announcement of the Draft Decree on Strategic Trade Control on April 1, 2025, marked a pivotal moment in the country’s trade policies. The draft decree goes beyond mere regulation; it serves as a tool for Vietnam to forge a controlled trade ecosystem that effectively manages the use, transfer, and import-export of high-tech products. This is a critical factor in attracting investments in key sectors such as semiconductors, AI, and digital technology.

Words and Deeds

During his visit to Washington in March 2025, Minister Nguyen Hong Dien engaged in direct discussions with the US Trade Representative and various American government agencies, showcasing Vietnam’s goodwill and presenting concrete proposals. One such proposal was the establishment of a strategic trade control mechanism to ensure transparency, prevent trade fraud, and foster trust with partners.

Upon his return to Vietnam, Minister Nguyen Hong Dien wasted no time in taking decisive action. The first meeting of the Drafting Committee was promptly convened, and within 24 hours, the draft was made publicly available online, reflecting the Ministry of Industry and Trade’s efficiency and commitment.

Dr. Le Quoc Phuong commended this move, stating, “Vietnam has proactively, responsibly, and practically addressed trade balance issues with the US.”

Simultaneously, Dr. Can Van Luc highlighted Vietnam’s proactive economic diplomacy strategy: “By increasing imports of strategic goods, strictly controlling illegal transshipment, and ensuring supply chain transparency, Vietnam is securing its position in the global value chain.”

Notably, Vietnam’s draft decree aligns with established international principles, including respecting intellectual property rights, prohibiting unauthorized technology transfers, and controlling core technologies.

Setting a Standard for Major Partners

Vietnam’s issuance of this decree goes beyond asserting policy autonomy, safeguarding long-term interests, and fostering sustainable cooperation. It also sends a message of exemplary conduct to its strategic partners: the US, the EU, and Japan.

These partners have long anticipated such a framework to confidently expand their investments, especially in fields with stringent technological security requirements. The decree, as planned, will elevate Vietnam’s status as a “trusted destination,” offering not only market potential but also regulatory reliability.

Vietnam’s swift action is noteworthy, introducing the draft just two weeks after high-level dialogues and making it publicly available for feedback. This transparent consultation model aligns with modern governance standards, on par with OECD countries.

Vietnam aspires not just to “join the game” but to help shape its rules. With the strategic trade control decree, Vietnam has the potential to become a model for institutionalizing trade commitments, promoting transparency in investment, and establishing itself as a responsible global player.

Building a Future of Trust

The true significance of this Draft Decree lies not in its technical clauses but in the message it conveys: Vietnam is, and will continue to be, a nation at the forefront of global integration and a trusted partner in international trade.

The future is not something to be awaited but is shaped by the timely decisions and actions of today. Vietnam is taking the lead, forging a path toward a future built on trust and mutual benefit.
